New 2013 I-9 Deadline

As you know, employers are required to complete an I-9 Form to verify the identity and employment authorization eligibility for newly hired employees and for re-verification purposes.  One of the many changes 2013 has brought employers is a new I-9 form.  The deadline to start using the new form is May 7th, 2013, the usage of an older form after this date is subject to penalties.

When to Fill Out Form I-9

 

New employees need to complete Form I-9 no later than the first day of work for pay. The employer must examine original documents presented by the employee, which show his or her identity and employment authorization, to complete the Form I-9 within 3 business days of the date employment begins.

 

How Long to Keep Form I-9

 

Employers must keep the completed Form I-9 for as long as the employee works for the employer. Once the individual's employment has terminated, the Form I-9 must be kept until the later of:

  • 3 years after the date of hire, or
  • One year after the date employment is terminated.
